He finished elementary at the Sacred Heart School for Boys in Cebu City. When the Pesta\u00f1o family relocated to Manila, Phillip transferred to Ateneo de Manila<!--more--> University, where he finished high&nbsp;school. He later joined the Philippine Military Academy.and graduated as an Ensign in the Philippine Navy in 1993. He was assigned as cargo master on board the BRP Bacolod City where he died on September 27, 1995.<\/p>\n<p><strong>Death<\/strong><\/p>\n<p>Phillip Pesta\u00f1o, 23, was shot and killed on Sept. 27, 1995. Before he was killed, he received a message from his classmates saying they feared something might happen to him inside BRP Bacolod. He told his father Felipe that he discovered anomalies committed inside BRP &nbsp;Bacolod such as the transport of illegal drugs, logs and illegal firearms. Felipe agreed to fetch his son upon the arrival of BRP Bacolod in the Navy headquarters on Roxas Blvd. in Manila, but Phillip was killed outside his room while the vessel was sailing from Cavite to Manila. \u201cHe was about to get his files on his exposes but he was killed outside the room and was transferred inside the room. In short, there was a lot of cover up on his death including the misleading story of suicide,\u201d said Philip&#8217;s father Felipe.<\/p>\n<p><strong><a href=\"http:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/philip-pestano.jpg\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" class=\"alignleft size-medium wp-image-1819\" title=\"philip pestano\" src=\"http:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/philip-pestano-203x300.jpg\" alt=\"\" width=\"203\" height=\"300\" srcset=\"https:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/philip-pestano-203x300.jpg 203w, https:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/philip-pestano.jpg 489w\" sizes=\"(max-width: 203px) 100vw, 203px\" \/><\/a>Investigations<\/strong><\/p>\n<p>The Navy investigators determined that Pesta\u00f1o had committed suicide because a \u201csuicide note\u201d was found in his cabin despite evidence that the note was not in Pesta\u00f1o\u2019s handwriting. As an honor student at Ateneo engaged to be married to the love of his life in a few months, Pesta\u00f1o also had no reason take his life.<\/p>\n<p>After two years of persistent prodding by Pesta\u00f1o\u2019s family, the Philippine Senate conducted an investigation of Pesta\u00f1o\u2019s death in 1997. Witnesses at the Senate hearing testified that before he died, Pesta\u00f1o refused to authorize the loading of 14,000 board feet of illegal hardwood logs in Tawi-Tawi even though its governor, Gerry Matba, had a gift for his good friend, Admiral Pio Carranza.<\/p>\n<p>Over Pesta\u00f1o\u2019s objections, the illegal logs were loaded in Tawi-Tawi and off-loaded in Cavite just before the ship sailed for its home port in Manila following an \u201cunusual dogleg route\u201d that lasted longer than usual. \u201cAn unexplained delay of about one hour and 15 minutes raises&nbsp;the presumption that the prolonged trip was occasioned by the time it took respondents to create the suicide scenario,\u201d Ombudsman Morales said.<\/p>\n<p>After hearing from numerous witnesses, the Senate Report (#800) concluded: \u201cPesta\u00f1o did not kill himself aboard the BRP Bacolod City\u2026 He was bludgeoned unconscious and then shot to death somewhere else in the vessel. His body was moved and laid on the bed where&nbsp;it was found.\u201d<\/p>\n<p>\u201cThe clear absence of blood spatters, bone fragments or other human tissues is physical evidence more eloquent than a hundred witnesses,\u201d the Senate report observed. \u201cIt is impossible for a person who has just sustained a fatal head injury to walk from some other place in&nbsp;his room, lie on his bed and drop dead\u2026\u201d<\/p>\n<p>\u201cHe was killed by an assailant, necessarily aboard the BRP Bacolod City\u201d, before it docked at the Navy HQ on Roxas Boulevard. The attempt to make it appear Pesta\u00f1o killed himself inside his stateroom was so deliberate and elaborate that one person could not have&nbsp;accomplished it by himself.\u201d<\/p>\n<p><strong>Senate Committee Findings<\/strong><\/p>\n<p>Murder, concluded the Senate committee led by Sen. Marcelo Fernan. Pesta\u00f1o was bludgeoned, shot and his body rigged to appear as a suicide. The Senate in 1997 then directed Ombudsman Aniano Desierto, to \u201cidentify the persons who participated in the deliberate&nbsp;attempt to make it appear that Pesta\u00f1o killed himself.\u201d &nbsp;&nbsp;Desierto ignored the Senate\u2019s directions. After he was replaced by Merceditas Gutierrez, the Pesta\u00f1o investigation met with the same, if not greater, indifference as Gutierrez refused to even meet with the parents of &nbsp;Pesta\u00f1o.<\/p>\n<p><strong>United Nations High Commission on Human Rights (UNHCHR) Press Release<\/strong><\/p>\n<p>On March 23, 2010, United Nations High Commission on Human Rights (UNHCHR) declared that Ensign Phillip Pestano of the Philippine Navy was the victim of violence, notwithstanding the findings by government agencies\u2014the Police, the Military, and the Department of Justice\u2014under three Presidents, from Ramos to Estrada to Arroyo, that Pestano committed suicide. The UN also found that the Philippine government under Ramos, Estrada, and Arroyo were directly complicit in depriving Pestano of life and the right redress of the crime &nbsp;committed against him by blocking the investigation of the case, as well as the prosecution of the perpetrators and imposition of the appropriate penalties. The UN has given the Philippine government 180 days to comply with the directives of the communication, i.e. the investigation, prosecution, and punishment of the perpetrators.<\/p>\n<div id=\"attachment_1830\" style=\"width: 310px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/pestano-family.jpg\" target=\"_blank\" rel=\"noopener noreferrer\"><img aria-describedby=\"caption-attachment-1830\" loading=\"lazy\" class=\"size-medium wp-image-1830\" title=\"pestano family\" src=\"http:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/pestano-family-300x211.jpg\" alt=\"\" width=\"300\" height=\"211\" srcset=\"https:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/pestano-family-300x211.jpg 300w, https:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/pestano-family.jpg 400w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-1830\" class=\"wp-caption-text\">The Pesta\u00f1o Family<\/p><\/div>\n<p><strong>Ombudsman&#8217;s dismissal of the case<\/strong><\/p>\n<p>In 2009, the anti-graft body, then headed by Ombudsman Merceditas Gutierrez, dismissed the complaint, saying the evidence was circumstantial. The Pesta\u00f1os filed a motion for reconsideration.<\/p>\n<p>On July 2010, former Akbayan representative Risa Hontiveros-Baraquel led the filing of an impeachment complaint against Gutierrez. BAYAN filed their own case on early August 2010. Led by Renato Reyes, BAYAN<\/p>\n<p>On August 2, 2010, The Office of the Ombudsman has dismissed the case on the alleged murder of Philippine Navy Ensign Phillip Pesta\u00f1o. In a May 17 joint resolution signed by Overall Deputy Ombudsman Orlando Casimiro, the Office of the Ombudsman dismissed the case against Navy Officers Capt. Ricardo Ordo\u00f1ez, LCDR Reynaldo Lopez, HM2 Welmenio Aquino, LCDR Luidegar Casis, Lt. Alfrederick Alba, Lt. Joselito Colico, Lt. Ruben Roque, PO1 Carlito Amoroso and several other John Does. \u201cAs things stand, no evidence was presented &nbsp;to show that respondents planned to kill Phillip or that their overt acts or inaction facilitated the alleged plan to kill Phillip,\u201d the resolution read.<\/p>\n<p>The family alleged the dismissal is \u201cmotivated by political revenge.\u201d \u201cFor five years, we have been waiting for the Ombudsman to act on our son&#8217;s murder case, then barely a week after we joined the impeachment complaint, the case that they sat on was dismissed,\u201d said&nbsp;Pesta\u00f1o\u2019s parents Evelyn and Felipe. \u201cAll we want is justice for our son. Namatay ang aming anak dahil nilabanan niya ang droga sa loob ng Navy. Sa pag -dismiss sa kaso, tila pinoprotektahan at kinakanlong ni Ombudsman Gutierrez ang mga higanteng naglalako ng droga sa ating lipunan,\u201d Evelyn said.<\/p>\n<p>The alleged inaction on the Pesta\u00f1o case was one of the grounds raised against Gutierrez during her impeachment in 2011. Gutierrez was also accused of alleged neglect of duty in failing to act on the criminal and administrative cases filed primarily against her former boss and President Gloria Macapagal-Arroyo and husband, Jose Miguel.<\/p>\n<p>On March 22, 2011, Ombudsman Merceditas Gutierrez was impeached by the House of Representatives for betrayal of public trust; in a historic vote of 212 \u201cYes\u201d, 46 \u201cNo\u201d, and four abstentions. Merceditas Gutierrez then submitted her resignation to President Benigno Aquino III in Malacanang Palace on April 29, 2011, days before she faced a trial in the Senate.<\/p>\n<div id=\"attachment_1843\" style=\"width: 310px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/pestanowithakbayan.jpg\" target=\"_blank\" rel=\"noopener noreferrer\"><img aria-describedby=\"caption-attachment-1843\" loading=\"lazy\" class=\"size-medium wp-image-1843 \" title=\"pestanowithakbayan\" src=\"http:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/pestanowithakbayan-300x199.jpg\" alt=\"\" width=\"300\" height=\"199\" srcset=\"https:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/pestanowithakbayan-300x199.jpg 300w, https:\/\/patnubay.org\/dokumento\/wp-content\/uploads\/2012\/02\/pestanowithakbayan.jpg 722w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-1843\" class=\"wp-caption-text\">Ensign Pesta\u00f1o's Family with Risa Hontiveros-Baraquel<\/p><\/div>\n<p>On January 11, 2011, The new Ombudsman Conchita Carpio Morales reversed the decision that originally dismissed Pesta\u00f1o&#8217;s death as one of suicide. A reinvestigation is rekindles the Pesta\u00f1os family&#8217;s hopes of proving that the navyman did not kill himself (as an official Armed Forces of the Philippines report said) and was in fact murdered for exposing shady activities by some officers in the Navy. The following ten naval officers are being pinned for Peta\u00f1os&#8217; alleged murder.<\/p>\n<p>1. Capt Ricardo Ordonez &#8211; retired Dec. 26, 2005;<br \/>\n2. CDR Reynaldo Lopez &#8211; active<br \/>\n3. LCDR Luidegar Casis &#8211; active<br \/>\n4. LCDR Alfrederick Alba &#8211; active<br \/>\n5. LCDR Joselito Colico- active<br \/>\n6. LCDR Ruben Roque &#8211; retired Dec. 12, 1997<br \/>\n7. HM2 Welmenio Aquino &#8211; active<br \/>\n8. MR2 Sandy Miranda &#8211; active<br \/>\n9. PO1 Carlito Amoroso &#8211; resigned from service Dec. 19, 1999<br \/>\n10. PO2 Leonor Igcasan &#8211; retired Sept. 19, 2011<\/p>\n<p><strong>Other Heroes<\/strong><\/p>\n<p>The cover-up of the murder of Pestano exacted other victims. Among them was Petty 0fficer (PO2) Zosimo Villanueva who was the officer who tipped Pesta\u00f1o on the presence of illegal cargo on the ship, specifically about \u201cthe concealed bulk of illegal drugs (hidden) in the more than 20 sacks of rice cargoes aboard the ship.\u201d A week after Pesta\u00f1o\u2019s murder, Villanueva was dispatched by his superiors on mission where he mysteriously \u201cwashed away in a sea mishap\u201d.<\/p>\n<p>Another casualty was Ensign Alvin Parone who was the officer who called Pesta\u00f1o\u2019s parents to warn them of plans to kill their son. He was also killed, then Sen. Alfredo Lim said, \u201ca victim of another unsolved murder.\u201d<\/p>\n<p>Also missing and presumed dead is Petty Officer (PO3) Fidel Tagaytay who was the duty officer on board Pesta\u00f1o\u2019s ship. When he was summoned to testify before the senate, he disappeared. His wife, Leonila, has been desperately searching for him, begging the authorities to investigate his disappearance.
