Dear Admin, Director Robert I recall in the ORR of RA8042, the authorized Insurance companies for the mandaturance are required to create and run a public website to provide information on their covered workers as it is today, there is non. Majority of newly deployed workers especially HSW do not know the name of their insurance companies neither their families. It could have been easy for the family of Ms Grace Pablo as well as NGOs and OFW Servant leaders to find out Ms Pablo’s recruitment agency and Insurance provider during time like this- a holy week.

The ORR and the IRR od the Insurance Comission for RA 10022 also include a provision requiring a mandatory opwning of “representative rance or office” for insurance companies in countries where their covered number of newly hired workers exceed 20,000 OFWs, this again is not implemented.

Dear Admin Hans, Director Obet there is a need to revisit and conduct diagnostic consultation with all the stakeholders in “fully implementing the provisions of the Bilateral Agreement on Domestic workers between the Philippines.”

The 24/7 Distress Assistance and Management System in Saudi and in the Philippines are not in place or fully working…. The bilateral agreement has also induced a new breeds of problems that are ditremental not only to our domestic workers but also to Saudi Employers.

Sirs. Here are my observations on the need to review the implementation of the Bilateral Agreement:

One of the major problem of the bilateral agreement is its inability to manage and stop the skyrocketing cost of recruitment being chargeg from Saudi Employers by licensed Saudi Recruitment Agencies.

These are hearsay on my part as I do not recruit HSWs but could be read in several news articles in Saudi… The recruitment cost paid by Saudi Employers rose to a range of SR 15,000 – 25,000… or more. It is now 3-5x more expensive to recruit a Filipino Domestic worker than to recruit a Senior Engineer…. What are its negative implications to both Fil HSWs and Saudi Employers and to the bilateral agreement? – (1) the recruiters in Saudi and their counterpart agencies in Manila are induced to become greedy and money driven; (2) quality selection and training is thrown-out of the window as they are enticed to recruit “as many and as fast as they can”. (3) most of the Saudi employers belongs to the middle class and because of the high cost- for them to employ a HSW, they touch their family savings or even borrow money or take loans from their employers or from banks, (4) while the high cost of recruitment is financially beneficial to (a) the Saudi agency, (b) Phil recruiters, (c) the applicants, as it offer no placement fee, free medical expnses, free passport, etc., (5) it becomes financially oppresive to Saudi Employers and they becomes more agitated and their frustration is thrown directly to the newly arrived HSWs., (6) to offset their exorbitant expenses, the Saudi Employers are encouraged to give more tasks, work to do to Fil HSWs, including for their extended family members.

(7) when the Saudi Employers found out that their newly arrived HSWs is raw from a distant province in the Philipines, could hardly speak English, poorly trained, cant work well based on their expectations, – maltreatment occurs like long hours of work, multiple houses to clean including other family members in the compound or in the city.

(8) employers could re-act to delay payment of her salary or under pay her, lower than the SR1500.00 in the contract…(9) when the situation becomes unbearable- (a) the HSW demands to be repatriated, (b) the Saudi employer refused and demand from HSW to refund the employers’ expenses, (c) both Employer and HSW complains to the Saudi/Phil Recruitment agencies- the employer demand for the refund of his expenses,,while the HSW demands to be sent home, (d) the Saudi Recruitment refuse to refund and shall “react” to offer to both Employer and HSW the transfer of the HSW to another employer in Saudi without the knowledge of POLO, POEA and the Phil agency- in this option, the Saudi Agency can charge the transferee Saudi Employer a higher recruitment cost, and the Saudi Recruiter now is able to pay/refund the expenses of the original Employer…

I believe there is a need for the Philippine and Saudi governments to do a reality check, jointly solve under the ambit of the “agreement” the current pending cases/problems of Filipino HSWs and Saudi Employers in Saudi and in the Philippines (for those who were maltreated and repatriated)…. At the same time (Second) call for immediate Philiipine DOLE and Saudi MOL holding for multi stakeholders consultation and review in Manila and in Saudi, (3) reconstitute the Saudi and Philippine Panel and include participation of private sectors and NGOs in both countries
