The New Article (5): Anong mga Propesyon o Trabaho ang Saklaw ng Saudi Labor Law?

The provisions of this Law shall apply to:

(1) Any contract whereby a person commits himself to work for an employer and under his management or supervision for a wage.
(2) Workers of the government and public organizations and institutions including those who work in pastures or agriculture.
(3) Workers of charitable institutions.
(4) Apprentice and training contracts with workers other than those working for the employer within the limits of the special provisions provided for in this Law.
(5) Part-time workers with respect to safety, occupational health and work injuries, as well as what is decided by the Minister.

Article 5 is first of the 38 new amendments in the Saudi Labor Law. The Amendments were approved by HRH King Salman by Royal Decree no. D/46 dated 5/6/1436H., corresponding to 25/3/2015G. and comes into force on 18 October 2015

Ommitted from (the old) Article 5

(4) Workers of agricultural and pastoral firms that employ ten or more workers.
(5) Workers of agricultural firms that process their own products.
(6) Workers who operate or repair agricultural machineries on a permanent basis.

Important Note:

Now, all agricultural and pastoral workers of private farms (owned by individual, company or establishment) are not included from the Saudi Labor Law; regardless of the number of workers a private farm has. POLO and POEA must not approve the contracts for farm workers.

Ang Bagong Artikulo (5):

Ang mga probisyon ng Batas na ito ay dapat umaplay sa:

(1) Anumang kontrata kung saan ang isang worker ay nakatuon ang trabaho para sa isang employer at sa ilalim ng kanyang pamamahala o pangangasiwa ng pasahod.
(2) Mga government workers or public workers kabilang ang mga workers na nagtatrabaho sa pastulan o agrikultura (na pagmamay-ari ng gobyerno).
(3) Mga Charity Organizations
(4) Mga Apprentice at training contracts (maliban sa mga trabaho na hindi sakop ng batas sa paggawa)
(5) Part-time workers para sa kaligtasan ng mga workers na may limitasyon, katulad ng may occupational sickness o occupational injury, o kung ano mapagdisisyonan ng Kalihim.

Ang Artikulo 5 ay pinakauna sa 38 na pagbabago sa Saudi Labor Law. Ang pagbabago ay inaprobahan ng HRH Haring Salman sa pamamagitan ng Royal Decree no. D / 46 petsa 5/6 / 1436H., Naaayon sa petsa ng Marso 25, 2015 G. at pinatupad noong Oktubre 18, 2015

Tinanggal na mula sa (mga gulang) Artikulo 5

(4) Mga agricultural at pastoral workers mga kumpanya na may higit sa sampu (10) ang bilang ng manggagawa.
(5) Mga workers ng farm companies na nagproseso ng kanilang sariling mga produkto.
(6) Mga permanent workers na nag-operate o magkumpuni ng farm machineries

Important Note:

Ngayon, lahat ng agricultural and pastoral workers ng private farms (pagmamay-ari ng individual, company or establishment) ay hindi na sakop ng Saudi Labor Law, gaano man karami ang kanilang manggagawa. POLO and POEA must not approve the contracts for farm workers.
