NOVEMBER 2015, nang ginawa natin ang flowchart na ito at naipost sa ating FB Page.

Marami nang articles ang patnubay tungkol sa mga ganitong kaso pero naisip natin na gumawa ng flowchart dahil may dalawang magkahiwalay na aksidente  na nangyari sa buwan na yon. Isang OFW nasawi dahil sa vehicular accident (work related) sa Yanbu, KSA at 13 OFWs ang nasawi dahil sa vehicular accident (work related din) sa Al Ahsa. KSA.

Ang OFW na nasawi sa Yanbu ay aking pinsan at natapos natin ang kaso na nakuha ng kanyang pamilya ang lahat ng benepisyo na nararapat sa kanila. Nasa baba ang buong detalye kung papano natin ito ginawa.  Tungkol naman sa kaso ng 13 OFW na nasawi sa Al Ahsa, walang lumalapit sa atin mula sa kanilang mga pamilya.

Pero umaasa tayo na nasulyapan ng kanilang pamilya ang ating flowchart at nakatanggap sila ng parehong mga benepisyo.

Dear Team,

Nais ko lang bigyan ng closure ang case na ito. Ang patnubay ay kilala na sa pagsarado ng bawat kaso na satisfied ang OFW at kanyang pamilya. Ang kasong ito ay naiba dahil kamag-anak ko po mismo ang ating naalalayan.

Magdalawang taon na pala mula nang pumanaw (by road traffic accident / work related) si Joseph Ryan (aking pinsan) sa Yanbu (KSA).

Maraming salamat ulit kay Congen Mel Panolong, Vice Consul Alex Estomo, Atty Anna Jacobo, Ka Jerome Friaz,  Amba Tago, USec Seguis at kay Admin Becky Calzado sa mabilisang pagrepatriate sa katawan ng aking pinsan, sa pagkakuha kanyang family sa benefits sa OWWA at sa last pay mula sa kanyang company . Maraming salamat din sa staff ng Jeraisy company kung saan nagwork ang aking pinsan noong buhay pa sya.

Last year, ang huling email update ko sa inyo ay inasikaso po namin ng aking tito boy (joseph ryan’s father) ang para sa Benefits for Work Related death mula GOSI – OHB para sa naiwang asawa at mga anak ng aking pinsan.

Alhamdulillah, sa huling linggo po ng August 2016 ay natangap ng family ng aking pinsan ang Death benefits from GOSI..  Ang mabilis na resulta ay dahil sa masipag na pagfollow-up ng tito boy sa GOSI-OHB thru email correspondence. (check the inserted email sa baba, ang palitan ng email ng aking tito hanggang sa mapadala ang cheque sa Pilipinas at natanggap ng asawa ni Joseph Ryan.)

Then came the sad news, October 1, 2016, pumanaw po si tito boy, father ni joseph ryan dahil sa karamdaman.

Inna lilllahi wa inna ilayhi rajiun. Ang kamatayan, katulad ng nangyari sa aking pinsan at sa aking tito ay nakalaan na sa atin kung kailan at papano mangyayari pero ang Ating Tagapaglikha lamang po ang nakaalam. Hindi natin alam ang tamang araw at oras na babalik tayo sa Kanya.

May kabilang-buhay po at doon po tayo magkita-kita  kung patuloy tayong mananampalataya at gumawa ng kabutihan.

Nasa baba po ang exchanges ng tito ko at ng GOSI. Ishare ko ito sa inyo para sa susunod na may magtatanong sa ating embahada or konsulada or POLO ay mapayohan nila kung papano ma-avail ang benefits for work related death sa Saudi Arabia.

Nasa baba din po ang mga email thread natin noon kung paano napadali ang pagrelease ng End of Service Benefits (ESB), OWWA Death Benefits at iba pang benepisyo para sa pamilya ng aking pinsan.

I just received a GOSI Application Form 31/A directly from GOSI Riyadh Regional office(Application for Payment of Heirs Benefits).

The latest update is we just got the NOC from Phil. Consulate Jeddah yesterday, I accompanied Mr. Ibrahim our company authorize employee to get the NOC. We travelled early, back and forth almost 700 kilometers. I am very hopeful that within this week the remains of Joseph will be repatriate to the Philippines. Mr. Ibrahim today went to the police station to settle one more document and he completely done.

One more document is needed to be complete and that’s required the flight details of remains repatriation. as per my info and understanding relayed by Mr. Ibrahim  Jawasat will not give an approval without the flight details.

About the personal belongings still we haven’t tackle the issue, or if we can  send together with the remains, any update for sure will inform you. Please let’s have more patience and perseverance for this matter, and by God’s grace all things will be settled.

As of Dec 9, natanggap ng Consulate ang mga documents from the Company for the issuance of the NOC, except for the copy of the Iqama of the company representative.  Kailangan itong copy ng Iqama ng representative para ma-isyu natin ang NOC. Nakikipag ugnayan kami sa company para ipadala na nila sa amin ito at umaasa kami na matatanggap namin ito sa lalung madaling panahon.

Jim, I just wanted to relay the txt of Mr. Danny Alifangco, a Filipino Manager in Jeraisy Riyadh. He said that they have sent all the documents to Jeddah Consulate after their documents was signed by the Embassy in Riyadh yesterday. They’re hoping that NOC will be issued soon by the Consulate so their company could book a scheduled flight for the Philippines.

We are still hopeful that Joseph’s remains will arrive before the 25th of this month so I could advise his brother & his family in Manila. I could not really tell them on the schedule of the burial. Their reason is it’s hard to get an airplane booking especially this Christmas season. They said they will attend the burial of Joseph. I have only two(2) sons David & Joseph the younger.

Regarding the GOSI I am not really sure if it was already reported by the company. Nobody from Jeraisy mentioned about it. I’m praying that everything will be accomplished & be overcome.

I was in Tacloban today and made a letter of request for the transfer of the records from DFA Cebu to DFA Tacloban. It is convenient for the family to do transactions in Tacloban.

By the way OWWA Tacloban told me to inform them of the arrival date so they could help in the releasing of the remains in the airport.

Jeraisy Ryanbu confirmed that the accident was reported already to GOSI, and they told me that by Sunday all requirements will be completed and hopefully the remains will be shipped out next week.

Please be informed that the Philippine Consulate General in Jeddah already received copies of the required documents for the issuance of a No Objection Certificate for Shipment of Remains. The employing company, however, was not able to send the copy of the Iqama of the person authorized to process the other required documents and clearances. The employing company informed us that they will send the said document through their branch here in Jeddah. The NOC will be issued as soon as we receive the lacking document.  

As to the GOSI claims, Jeddah PCG will coordinate with the employing company regarding this matter.

Jeddah PCG will apprise you on significant developments on the shipment of the remains of your cousin, as well as on the release of his ESB and other monetary entitlements.

First, I would like to inquire from Ambassador Tago and from Vice Consul Alex if the “Letter for the Acceptance of Remains” is already received by our embassy in Riyadh or by our consulate in Jeddah.

Last December 1, 2015 , my uncle went to the DFA-OUMWA office in Cebu for the issuance of the acceptance of remains letter.  

We understand that there is a little delay on these processes; first, the DFA Cebu would forward the letter to the DFA Manila and DFA Manila will forward to our Embassy in Riyadh or to Jeddah Consulate.

Last week, I was able to talk with the my cousin’s Saudi co-worker in Yanbu, Jeraisy (my cousin’s company). I suggested  that the company must report the work-related death to the GOSI-OHB Office and that my cousin’s beneficiaries are entitled for the death benefits from GOSI-OHB.  

He promised me that he would relay my requests to their manager. I also asked him to relay to their boss… that all the company needs to do (for the death benefits from social insurance) is to report to GOSI with the supporting proofs that the cause of death is work-related. GOSI-OHB will then communicate with my cousin’s family about the cheque that GOSI will send to my cousin’s family.

Last Monday, my uncle forwarded to me the copies of the email exchanges between him and Jeraisy, .  

In one email, Jeraisy replied that the company needs the “Letter for the Acceptance of Remains”, and that the letter must be authenticated by our DFA Manila and by the Saudi Embassy in Manila.

Today I called Jeraisy Yanbu and they told me that they are still waiting for the “Letter of Acceptance of Remains “. My uncle sent to them the copy of that letter but the company needs the original letter authenticated by DFA and the Saudi Embassy.  

I also inquired from them if the work-related accident is already reported to GOSI-OHB. They replied in the affirmative and they promised me that they will submit all copies of the documents to our embassy here in Riyadh.

I also suggested that the documents must be submitted to the Philippine Consulate in Jeddah since our consulate has the jurisdiction over Yanbu area.

They told me that the No Objection Certificate will be processed in the Philippine Embassy in Riyadh because the Jeraisy Head Office is in Riyadh and that they already forwarded all the documents to Riyadh.

Our Requests:

It is obvious that we cannot move forward until the “Letter of Acceptance of Remains” reaches the Riyadh Embassy or Jeddah Consulate.  Thus, it is important for us, specially for my cousin’s direct family to know where the letter is now. We also would like to request from our embassy or from our consulate to confirm with Jeraisy if the work related death is already reported to GOSI-OHB.  

I will be on leave starting from December 24 to January 10;  I hope that the remains of my cousin will be repatriated before my flight date and I hope that will be able to attend his burial.

Thank you for the latest info. I will be going to Cebu tomorrow to sign a letter of request to claim the remains of my son Joseph.

It will be in the DFA Cebu and the letter to be forwarded to the Embassy in Riyadh.

This is one of the requirements needed so they could transport Joseph’s body to Cebu’. It would be good if the proof that it is a work related accident would be reported immediately to the Embassy in Riyadh so that he will qualify for the social insurance.

I would like to request for your assistance to the family of the late OFW Joseph Ryan Balamon (my cousin) who died from a Road Traffic Accident in Yanbu, KSA,  last November 23, 2015, at 11:45, Monday.

Our Requests are the Following

1. DFA  

1. a – To hasten the repatriation of the remains of OFW Balamon and to ensure that all monetary claims and benefits must be received his family whose names and contact numbers are listed below.

2. a – For NOC (No Objection Certificate) and for constant follow-up with the company the hasten the repatriation of my cousin’s remains.

Note: My cousin’s dead body is in Yanbu which is under the jurisdiction of our Consulate in Jeddah but the Head Office of his company is in Riyadh which is under our embassy’s jurisdiction.

2.b. for the monetary claims which are the following:

– Unpaid salary
– Unused Vacation – Pay
– End of Service Benefits
– Death Benefits from GOSI (Goverment Organization for Social Insurance)  – please advise the company that since this is a work related death, then the company must report this to the GOSI-OHB (Occupational Hazard Branch) which the family of the worker is entitled to receive a death benefit equivalent to  84 months salary (7 years salary) but maximum of 330 thousand saudi riyals.. Once approved, the GOSI will send the cheque directly to the beneficiary (family of the worker).. At this stage.. it is important that the company must report the work related death to the GOSI Office.

3. OWWA –  Social Benefits Claim

– Death Benefit   of 200 thousand Pesos for accident
– Burial Assistance of 20 thousand Pesos
– OFW Balamon is an active OWWA member

4. POEA   – Accident Death Benefits from Compulsory Insurance (RA10022)

–  I do not have information yet if my cousin was a new hire (first contract) but if he was, then his family is entitled for 10,000 USD accident benefits from RA10022’s Compulsory Insurance Coverage.   You may disregard this request if in case the OFW is a balik manggagawa.

Yan lang po sa ngayon, mag-update po kami once makaprocess na ng acceptance of remains letter ang family ni OFW Balamon.
