Google Translation from Arabic to English.

Ministry of Human Resources and Social Development clarifies the details of Article (41) that was added to the list to protect the contractual relationship

The Ministry of Human Resources and Social Development clarified the details and reasons for its decision issued to improve and protect the contractual relationship between workers and employers, which comes as a support to the efforts of the government of the Kingdom of Saudi Arabia to control the repercussions of the new Corona virus, as article No. (41) has been added to the executive regulations of the system The work issued by Ministerial Resolution No. (70273) dated 04/11 / 1440H states the following: In implementing the provisions of paragraph (5) of Article Seventy-Four of the Law:

1- In the event that the state, on its own initiative or based on what is recommended by a competent international organization, takes measures regarding a situation or circumstance that requires a reduction in working hours, or precautionary measures that limit the aggravation of that case or that circumstance, which is included in the description of the force majeure mentioned in the paragraph (5) From Article (74) of the system, the employer will agree with the worker – within the six months following the start of taking these measures – on any of the following:

  • Reducing the worker’s wages, in proportion to the actual number of working hours. (Napakalinaw! Kung walang trabaho, then walang sahod. Sa English, NO WORK, NO PAY!)
  • Granting the worker leave that is calculated from the days of his annual leave due. (Ipapagamit sa worker ang kanyang annual vacation with pay habang nakastand-by sa accomodation dahil wala siyang trabaho sanhi ng crisis. Napakalinaw, na yan ay FORCED LEAVE!)
  • Granting the worker exceptional leave, according to what is stipulated in Article (116) of the system. Napakalinaw na ito ay parehong NO WORK NO PAY at FORCED LEAVE)

2- The termination of the work contract after that is not legitimate if it is proven that the employer has benefited from any state subsidy to face this situation.

3- This does not prejudice the worker’s right to terminate the work contract. ”This initiative is an extension of the Ministry of Human Resources and Social Development’s initiatives to mitigate the economic impacts on the private sector and achieve the public interest of workers and employers.

Patnubay Notes:

Dahil sa COVID-19 crisis naging legal ang NO WORK NO PAY at FORCED LEAVE.

NO WORK NO PAY at FORCED LEAVE.

NO WORK NO PAY at FORCED LEAVE.

Let us Pray.

May the Almighty Creator enlighten the mind and soften the heart of Secretary Bello.

May the Almighty bless and protect all the OFW and all our families!

May the Almighty Creator enlighten the mind and soften the heart of Secretary Bello.

May the Almighty Creator bless our country and our leaders.

May the Almighty Creator enlighten the mind and soften the heart of Secretary Bello.

Allahuma Ameen!

Malaki pa rin ang aking paniniwala na ang pagka-intindi ni Secretary Bello sa NO WORK NO PAY ay mga contractual workers, o part time workers, o endo o JO.
